Yard Dawgs Terms of Service

Welcome to Yard Dawgs! By purchasing our services, you are agreeing to these Terms of Service and the automatic annual renewal of services. Please read them carefully. 

1. Overview Yard Dawgs Lawn Care Ltd. ("Yard Dawgs", "we", "us", or "our") provides professional lawn care services across Alberta and Saskatchewan. These Terms govern your use of our services and website.

2. Services Provided We offer full-season and mid-season lawn care programs that typically include:

• Lawn fertilization

• Weed control

• Aeration (liquid or mechanical)

• Slit seeding and overseeding

• Soil and plant health boosters such as super juice or sea kelp

• Optional add-ons (e.g., chinch bug control, hardscape weed control, and other seasonal treatments)

Our services are weather-dependent and may vary. Customers are responsible for ensuring clear lawn access on scheduled service dates. By purchasing, you agree to receive these services as described.

3. Customer Responsibilities

• Ensure lawn access (gates unlocked, pets secured).

• Maintain regular lawn watering and mowing.

• Notify us of any service concerns within 48 hours of visit.

• Provide accurate and up-to-date contact and payment information.

• Notify us promptly of any changes to email or mailing addresses.

4. Payments, Billing & Renewals

• Services are billed on a subscription basis, as agreed upon at purchase.

• Pre-authorized payment is required. You authorize Yard Dawgs to store your credit card information and to charge your payment method on file for services, including automatic renewals.

• Services have an initial term of one lawn care season (typically 6 months).

• Unless canceled with written or verbal notice, your services will auto-renew for a full season length the following year. For example, if you purchased a mid-season 2-round program, it will renew as a full 3-round program in the subsequent season.

• Refunds or service credits are offered at Yard Dawgs' discretion.

• Overdue invoices may incur late fees or service suspension.

• We do not offer one-off services. All services are part of ongoing seasonal programs.

5. Price Changes

• We may adjust service pricing annually. Price increases below 10% will be communicated via email and/or mail with a summary of updated fees.

• Price increases of 10% or more require your express written consent before services are renewed.

• It is your responsibility to review communications regarding pricing.

6. Cancellation & Termination

• You may cancel services at any time by providing written notice (email acceptable) or by calling us at (587) 254-2337 or emailing support@yarddawgs.ca.

• Cancellations will be effective at the end of the current service term.

• Pro-rata refunds for pre-paid services may be considered at Yard Dawgs' discretion.

• Failure to provide updated contact information may result in unintended service continuation and charges.

7. Limitation of Liability

• Yard Dawgs' total liability for any claim related to our services is limited to the amount you paid for the specific service in question, up to a maximum of $100.

• We are not liable for indirect, incidental, or consequential damages.

• Yard Dawgs is not responsible for damage to underground sprinklers, utilities, or fixtures not properly flagged or disclosed.

• This limitation of liability section is highlighted to ensure consumer awareness.

8. Dispute Resolution

• Customers agree to attempt informal resolution of disputes by contacting Yard Dawgs' customer service.

• If a resolution is not achieved within 14 days, disputes will proceed to mediation or arbitration in Calgary, Alberta.

• Customers must engage in this process before pursuing any formal legal claims.

• These Terms are governed by the laws of Alberta, Canada.

9. Website Use & Intellectual Property

• Access to Our Site is provided "as is" and "as available".

• All content on Our Site is owned or licensed by Yard Dawgs and is protected by Canadian and international intellectual property laws.

• You may access, view, and print pages for personal, non-commercial use only.

• You must not reproduce, distribute, or modify Our Site content without express written permission.

10. Viruses, Malware & Security

• Yard Dawgs exercises reasonable care to keep Our Site secure and free from malware.

• You are responsible for your own device security.

• Any attempt to harm or disrupt Our Site’s security will result in immediate termination of access and may be reported to authorities.

11. Acceptable Usage Policy

• You agree to use Our Site lawfully and not engage in activities that could harm Yard Dawgs or other users.

• We reserve the right to suspend or terminate access for violations of this policy.

12. Electronic Communications Consent By purchasing our services, you consent to receive electronic communications from Yard Dawgs, including notices regarding services, renewals, updates, and other important information. These communications are part of your relationship with us.

13. No Waiver Clause Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Yard Dawgs.

14. Changes to Terms We may update these Terms from time to time. Updated versions will be posted on our website. Continued use of our services or website constitutes acceptance of changes.
